What is trademark class?

In accordance with the NICE classification for trademarks, also known as the International Certification of Goods and Services, trademarks can be classified into 45 different classes. Goods and services are distinguished by trademark classes.

To avoid discrepancies, it is necessary to conduct a trademark search before filing a trademark application. Registration of a trademark can be hindered if the mark is classified incorrectly.

Businesses can apply for trademarks in more than one class if they provide a variety of goods or services that fall under different trademark classifications. The same mark can be registered under more than one class, even if it has already been registered under a particular class.

Therefore, filing a trademark application under one class does not grant complete exclusivity over the mark’s use. When a trademark is registered, it gives the owner exclusive rights to use the mark in relation to a particular class of goods or services. Use the trademark class finder tool to find the correct trademark class for your goods or service from over 80,000 goods and services.

Of the 45 classes listed below, 34 belong to the Goods section, while 11 belong to the Service section.

Basis of Trademark classification

Trademark Classification of Goods

The purpose and function of a finished product determine its classification. The finished product is compared with those listed in the list if it isn’t listed in any of the trademark class.

There are multiple classes for multipurpose products, each corresponding to a specific function. These functions aren’t mentioned in any class, so other criteria can be used, such as the raw materials of the product or its operation method.

Depending on the material they are made of, raw materials and semi-worked products are categorized. The product is categorized by the material that dominates when it is composed of different materials.

Trademark Classification of Services

According to the service classes’ headings and the explanatory notes, services are categorised according to branches of activities.

Rental services get classified in the same class.

The services that provide advice, information, or consultation are classified with those that relate to the subject matter of the advice, information, or consultation.
